These terms govern the services of Swiss Creative Design Studio (“the studio”) and the use of the client portal. By creating an account, you (“the client”) accept them. Please read them carefully: they explain what is included in each offer, how revisions work and what we are and are not responsible for.
1. the services
The studio designs and builds custom websites (the “launch” package) and offers optional monthly care plans (care, care plus, care ultra) covering hosting, maintenance and revision rounds. Prices and the content of each offer are shown on the website at the time of the order.
Our offer is built around one idea: a website designed specifically for you, at a fraction of the usual price. To make that possible, the scope of each offer is deliberately defined and limited, as described below.
2. the launch package
The launch package includes the design and development of a simple, custom-made website of 1 to 10 pages, responsive on every device.
The website is static: it is not connected to a database, a content management system or any third-party service (for example online shop, booking system, payment, newsletter or customer account), unless the studio has explicitly agreed otherwise in writing.
Not included unless agreed in writing: writing or translating texts, producing photos or videos, buying a domain name, setting up email addresses, search-engine advertising and any feature beyond the scope above. These can be quoted separately.
The client provides the content of the website (texts, images, logos, documents) and confirms that they hold the rights to use it. The studio may use neutral placeholder content until the final content is provided.
3. orders, timeline and delivery
The client requests a project in the portal. The studio reviews the request and may accept it, ask for changes or decline it. Work starts once the request is validated, the payment has been received and the content needed to start has been provided.
The usual timeline is 1 to 2 weeks. It is an estimate, not a binding deadline: the studio reserves the right to extend it for any reasonable reason, in particular late or incomplete content or feedback from the client, the complexity of the project, illness, technical issues with third parties or force majeure. The studio will keep the client informed in the portal.
The website is considered delivered when the studio puts it online or marks it as delivered in the portal. The client then has 7 days to report any technical error (something that does not work as agreed); the studio fixes such errors at no cost. After that period, or as soon as the client uses the website, the delivery is considered accepted.
Design choices (colours, layout, typography, wording) are made in the studio’s professional judgement on the basis of the request. Personal preferences about the result are handled through revision rounds and are not a technical error.
4. prices and payment
Prices are in Swiss francs (CHF). The launch package is paid in full in advance, together with the first month of the care plan if one is chosen. Payments are made online through our payment provider (Stripe).
Promotion codes are only valid on the products they are issued for, cannot be exchanged for cash and can be withdrawn at any time before they are used.
5. no refunds
Because every website is made to measure and work starts as soon as the order is paid, all payments are final and non-refundable, including when the client is not satisfied with the result, changes their mind, stops the project or does not provide the content needed. Swiss law does not provide a right of withdrawal for these services.
If the client is not happy with the result, the studio’s commitment is to work with them through the delivery check and, with a care plan, the revision rounds included in their plan.
6. care plans
Care plans are monthly subscriptions. They renew automatically each month until the client stops them in the portal. A stopped plan stays active until the end of the period already paid; there is no refund for a partial month.
Switching to a higher plan takes effect immediately and is charged right away (a new monthly period starts and the unused part of the current plan is deducted). Switching to a lower plan takes effect at the next renewal.
Hosting is part of the care plans: the website is only kept online while a care plan is active. If there is no active plan, if the client stops their plan or if a payment fails and is not settled, the studio may take the website offline. It can be put back online by subscribing again.
7. revision rounds
A revision round is one request sent through the client portal. It is meant for small changes to the existing website, for example text edits, replacing or adding up to 20 images, or replacing documents such as PDF files.
Revision rounds do not include creating new pages, new sections or new features, nor redesigning existing ones. Such work can be quoted separately.
The studio carries out a revision within 7 days of receiving it. It is the client’s responsibility to send their requests early enough before the date they need them online.
The studio may refuse a revision request, or carry out only part of it, if it considers the work too large for a revision round. In that case the client may split the request, upgrade to a higher care plan or ask for a separate quote.
The number of rounds depends on the care plan. Rounds reset at the start of each billing period; unused rounds do not carry over and cannot be refunded.
8. client responsibilities
The client provides accurate information, keeps their account credentials confidential and is responsible for what is done with their account.
The client guarantees that the content they provide does not infringe the rights of others (copyright, trademarks, image rights, personal data) and is lawful. The client indemnifies the studio against any claim resulting from that content. The studio may refuse content that is unlawful, offensive or contrary to its values.
The client is responsible for the legal content of their own website (for example legal notice, privacy policy, prices or product claims).
9. intellectual property and project files
Once the launch package is paid in full, the client may use the delivered website freely for their business. At any time, the client may ask for a copy of the full project folder (source code and assets of their website) at no extra cost.
The studio keeps the rights to its own tools, methods, code components and know-how used across projects. Third-party elements (such as fonts or images) remain subject to their own licences.
The studio may show the website in its portfolio and on social media, unless the client asks it not to in writing.
10. availability and liability
The studio takes care to keep the websites it hosts online and secure, but cannot guarantee uninterrupted availability. Maintenance, updates or incidents with technical providers may cause short interruptions.
To the extent permitted by law, the studio is not liable for indirect or consequential damage, such as lost profit, lost revenue, lost data or damage to reputation, nor for the content provided by the client or the services of third parties. The studio’s total liability is limited to the amount paid by the client for the service concerned over the last 12 months. Liability for intent or gross negligence remains as provided by law.
11. suspension and termination
The studio may suspend its services or take a website offline in the event of non-payment, misuse of the portal, unlawful content or a serious breach of these terms, after informing the client where possible.
The client may close their account at any time by writing to the studio. Amounts already paid remain due and are not refunded.
12. changes to these terms
The studio may update these terms. The version in force is published on this page with its date. Significant changes are announced in the portal or by email; continuing to use the services after that means accepting the new version.
13. applicable law and jurisdiction
These terms are governed by Swiss law. The courts of Geneva, Switzerland, have exclusive jurisdiction, subject to mandatory rules on consumer jurisdiction. Questions about these terms: swisscreativedesignstudio@gmail.com.
